What exactly is Stock Photography?

 

 

 

 

 

Stock Photographs are professional images of common places, landmarks, nature, events and / or people that are bought and sold on a royalty-free basis and can be used and reused for commercial design purposes. The photographer has ownership to the images, while the license purchaser limited usage of the photo, which is set out in the Terms of Service by the company the license is purchased from.
The licensed images may under no circumstances be used as content in a pornographic, defamatory or other unlawful manner.

What will the Images be used for? Who is licensing them?
The images produced will be primarily commercialised on image banks (stock libraries). Once the client purchases them, they can be used on a variety of media.  Vermut Production’s photographers images are only available in stock libraries of international renown.
Where will the images be published?
The images can be used in websites; blog posts; social media; advertisements; marketing campaigns; corporate presentations; newspapers; magazines; books; film and television productions; web and mobile applications; product packaging.

What are the implications of joining Vermut Productions?

 

By joining you are letting us know that you are willing to be casted as a model for a STOCK imagery photoshoot. It does not imply that you are obliged to participate. You are not required to pay for any service. The information you are providing us is only so that the photography teams can select you as a possible candidate for one or more of their shoots.

 

 

Do models have to pay a fee or commission?

 

Absolutely not.

 

Are stock photographs and photos for image banks the same thing?

Yes both are terms that describe the same type of images. Images licensed on specific platforms.

 

What about copyrights?

Copyrights are RF – royaly free.

 

Can or will I obtain photos as compensation?

That will depend on the conditions agreed with the photographer. In any eventuality thee photos would be web resolution and would include a watermark. Photographers are not permitted to give photos in high resolution or without watermark by their contract with the stock libraries.

Can I use the photographs in my social media?

Yes absolutely.

 

Do I have to sign a copyright release?

Prior to any shoot a model release must be signed. Herebelow you can find the conditions.

Model Release Conditions: For Consideration herein acknowledged as received, and by signing this release I hereby give the Photographer / Filmmaker and Assigns my permission to license the Content and to use the Content in any Media for any purpose (except pornographic or defamatory) which may include, among others, advertising, promotion, marketing and packaging for any product or service. I agree that the Content may be combined with other images, text, graphics, film, audio, audio-visual works; and may be cropped, altered or modified. I acknowledge and agree that I have consented to publication of my ethnicity(ies) and gender as indicated below, but understand that other ethnicities or gender may be associated with me by the Photographer / Filmmaker and / or Assigns for descriptive purposes. I agree that I have no rights to the Content, and all rights to the Content belong to the Photographer / Filmmaker and Assigns. I acknowledge and agree that I have no further right to additional consideration or accounting, and that I will make no further claim for any reason to Photographer / Filmmaker and / or Assigns. I acknowledge and agree that this release is binding upon my heirs and assigns. I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the laws (excluding the law of conflicts) of the country/state from the following list that is nearest to the address of the Model (or Parent*) given opposite: New York, Alberta, England, Australia and New Zealand. It is agreed that my personal information will not be made publicly available but may only be used directly in relation to the licensing of the Content where necessary (e.g. to defend claims, protect rights or notify trade unions) and may be retained as long as necessary to fulfill this purpose, including by being shared with sub-licensees / assignees of the Photographer / Filmmaker and transferred to countries with differing data protection and privacy laws where it may be stored, accessed and used. I represent and warrant that I am at least 18 years of age and have the full legal capacity to execute this release. Definitions: “ASSIGNS” means a person or any company to whom Photographer/Filmmaker has assigned or licensed rights under this release as well as the licensees of any such person or company. “CONSIDERATION” means $1 or something else of value I have received in exchange for the rights granted by me in this release. “CONTENT” means all photographs, film, audio, or other recording, still or moving, taken of me as part of the Shoot. “MEDIA” means all media including digital, electronic, print, television, film, radio and other media now known or to be invented. “MODEL” means me and includes my appearance, likeness and voice. “PARENT” means the parent and/or legal guardian of the Model. Parent and Model are referred to together as “I” and “me” in this release, as the context dictates. “PHOTOGRAPHER / FILMMAKER” means photographer, illustrator, filmmaker or cinematographer, or any other person or entity photographing or recording me. “SHOOT” means the photographic, film or recording session described in this form. *If Model is a minor or lacks capacity in the jurisdiction of residence, Parent warrants and represents that Parent is the legal guardian of Model, and has the full legal capacity to consent to the Shoot and to execute this release OF ALL RIGHTS IN MODEL’S CONTENT.

How is the copyright release remunerated?

A one time flat fee is paid for the shoot and copyrights. The fee is agreed upon with the photographer before the shoot.

What kind of locations are required?

Offices, co-working spaces, sports facilities, stores, all kinds of industry, medical, investigation, schools, homes, gardens, etc.

 

How are the location and its contents insured?

An insurance policy is taken on the location and its contents for the duration of the shoot.

 

What are the conditions and copyrights cession required for a location?

All locations must be clean and tidy on the shoot day. Any valuable or copyright sensitive items, must be removed and stored safely by the location owner.

A property release must be signed prior to the shoot. Below are the terms of the release:

Property Release: As owner or authorized representative of the Property and by signing this release, I give the Photographer / Filmmaker and Assigns my permission to create and use the Content depicting the Property in any Media, for any purpose (excluding defamation and / or pornography) which may include, among others, advertising, promotion, marketing and packaging for any product or service. I agree that the Content may be combined with other content, text and graphics and cropped, altered or modified. I agree that all rights to the Content belong to the Photographer / Filmmaker and / or Assigns. I agree that I have received Consideration for the rights granted in this release. I acknowledge and agree that I have no further right to additional Consideration or accounting, and that I will make no further claim for any reason to Photographer / Filmmaker and / or Assigns. I acknowledge and agree that this release is binding upon my heirs if applicable, assigns or any person claiming an interest in the Property. I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the laws (excluding the law of conflicts) of the country / state from the following list that is nearest to the address of the owner or authorized representative given opposite: New York, Alberta, England, Australia and New Zealand. It is agreed that my personal information will not be made publicly available but may only be used directly in relation to the licensing of the relevant Content where necessary (e.g. to defend claims, protect rights or notify trade unions) and may be retained as long as necessary to fulfill this purpose, including by being shared with sub-licensees / assignees of the Photographer / Filmmaker and transferred to countries with differing data protection and privacy laws where it may be stored, accessed and used.I represent and warrant that I am at least 18 years of age. I have the full legal capacity and right to execute this release and grant the rights herein granted with respect to the Property, and to bind all persons claiming an interest in the Property. Definitions: “ASSIGNS” means a person or any company to whom Photographer / Filmmaker has assigned or licensed rights under this release as well as the licensees of any such person or company. “CONSIDERATION” means $1 or something else of value I have received in exchange for the rights granted by me in this release. “CONTENTS” means all photographs, film or recording, still or moving, taken of the Property as part of the Shoot. “MEDIA” means all media including digital, electronic, print, television, film and other media now known or to be invented. “PHOTOGRAPHER / FILMMAKER” means photographer, illustrator, filmmaker or cinematographer, or any other person or entity photographing or recording the Property. “PROPERTY” means the place and or property (real estate or intellectual property) that is the subject of the Shoot. “SHOOT” means the photographic or film session described in this form.

What about copyright sensitive objects in a location?

All copyright sensible objects should be removed from the location prior to the shoot by owner.

 

Who is responsible for cleaning after the shoot?

 

The photography crew is responsible for returning the location in the same state they found it.
